1. Overview

This website is operated by ALPA RACING USA LLC d/b/a Race Code ("Race Code," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of race-code.com (the "Site") and any purchase you make through it. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Site and place orders. By using the Site, you represent that you meet this requirement.

3. Products and pricing

  • All prices are listed in USD unless otherwise stated and are exclusive of taxes, duties and shipping fees, which will be calculated at checkout when applicable.
  • We reserve the right to modify prices, discontinue products, and limit order quantities at any time without prior notice.
  • We make reasonable efforts to display product images and descriptions accurately, but we do not guarantee that colors, sizes or details shown on your screen match the physical product exactly.
  • In the event of a pricing or product error, we reserve the right to cancel any affected order, even after confirmation, and to issue a full refund.

4. Orders and payment

  • Placing an order constitutes an offer to purchase. Your order is not accepted until we send an order confirmation email.
  • We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud, unauthorized or illegal activity, or inventory errors.
  • Payment is processed at the time of order. We accept the payment methods shown at checkout.
  • You represent that you are authorized to use the payment method provided.

5. Shipping and delivery

Shipping is governed by our Shipping Policy. Delivery times are estimates and are not guaranteed. Title and risk of loss pass to you upon the carrier's acceptance of the package.

6. Returns and refunds

Returns are governed by our Return & Refund Policy. Please review it before placing an order.

7. Intellectual property

All content on the Site — including logos, trademarks, text, graphics, photos, videos, designs and code — is the property of Race Code or its licensors and is protected by copyright, trademark and other intellectual-property laws.

You may not reproduce, distribute, modify, display, publicly perform, republish, download, store, transmit or commercially exploit any of this content without prior written consent from Race Code.

"Race Code" and related marks, logos and designs are trademarks of ALPA RACING USA LLC. All rights reserved.

8. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to any portion of the Site or its systems
  • Interfere with the Site's operation (e.g., denial-of-service, scraping beyond reasonable use)
  • Impersonate another person or misrepresent your affiliation
  • Submit false information or use a fraudulent payment method

We reserve the right to suspend or terminate your access to the Site for any violation.

9. User-generated content

If you post reviews, comments or other content on the Site or tag Race Code on social media, you grant Race Code a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify and display that content in connection with our business, including marketing. You represent that the content is yours and does not infringe any third party's rights.

10. Disclaimers

The Site and all products are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose or non-infringement, except as required by applicable law.

We do not warrant that the Site will be uninterrupted, secure or error-free, or that defects will be corrected.

11. Limitation of liability

To the maximum extent permitted by law, Race Code and ALPA RACING USA LLC, their officers, employees and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages arising from or related to your use of the Site or any product purchased, even if advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to these Terms or the Site will not exceed the amount you paid for the product(s) that gave rise to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Race Code, ALPA RACING USA LLC and their affiliates from any claim, damages, losses or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site.

13. Governing law and dispute resolution

These Terms are governed by the laws of the State of Indiana, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be resolved in the state or federal courts located in the State of Indiana, and you consent to the personal jurisdiction of those courts.

If you are an EU-resident consumer, mandatory consumer-protection provisions of your country of residence continue to apply, and you may have the right to bring proceedings in your local courts.

14. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on the Site with a new "Last updated" date. Continued use of the Site after changes constitutes acceptance of the updated Terms.
